EXCERPT FROM THE MINUTES OF THE REGULAR SESSION OF THE SANGGUNIANG BAYAN OF MAMBURAO, OCCODENTAL MINDORO HELD ON NOVEMBER 23, 2009 AT SUNNGANIANG BAYAN SESSION HALL.                   

MUNICIPAL ORDINANCE No. 19               
               
"AN ORDINANCE REQUIRING THE SEGREGATION AT THE SOURCE OF ALL HOUSEHOLD, NSTITUTIONAL, INDUSTRILA AND COMMERCIAL WASTE AND/ OR GARBAGE INTO WET OR BIODEGRADABLE AND DRY OR NON -BIODEGRADABLE PURSUANT TO REPUBLIC ACT. NO. 9003"               
               
               

"Whereas, Republic  No. 9003 provides for an ecological solid waste mnagement program, creates  the necessary institutional mechanisms and incemtives. Declares certain acts prohibited and provides for penalty and appropriate funds therefore ;"               
               
       
Whereas, Section 10 of the above - cited Republic Act provides that " pursuant to the relevant provisionsof R.A. no. 7160, otherwise known as the Local Government Code of 1991. The LGUs shall be primarily responsible for the implementation and enforcement of the provisions of this act within their respective jurisdictions;               
                           
               
"Whereas, Section 21 ( Mandatory Segregation of Solid Waste) of R.A. No. 9003 has likewise provided that, "" x x x LGUs shall evaluate alternative roles for the public and private sectors in providingcollection services, type of collection system, or combination of systems, that best meet thier needs; Provided, That segregation of wastes shall primarily be conducted at the source to includehousehold, institutional, industrial, commercial and agricultural source; x x x "" ; and Section 22 of the same Act has likewise called fro teh standards and requirements for segregation and storage of solid waste;                           
               
"NOW THEREFORE, BE IT ORDAINED, BY THE SANGGUNIANG BAYAN OF MAMBURAO, in its  session assembled that :"               
               
               
SECTION 1.     The Municipal Government of Mamburao hereby requires the segregation at the source of all household, institutional, industrial and commercial waste and/ or  garbage into wet or biodegradable and dry or non - biodegradable pursuant to republic Act No. 9003       

SECTION 2.     For purposes of this ordinance, the following terms are hereby defined as follows :           
               
(a) SEGREGATION shall refer to a solid waste management practice of separating different materialsfound in solid waste in order to promote recycling and re- use of resources and to reduce.

(b) SEGREGATION AT SOURCE shall refer to solid waste management, practice of separating, at the point, of origin, different materials found in solid waste in order to promote recycling and re-use of resources and to reduce the voulume of waste for collection and disposal.

(c) HOUSEHOLD, INSTITUTIONAL, AND COMMERCIAL WASTE OR GARBAGE shall refer to all discarded wet or dry waste in household, business establishment, commercial waste, non- hazardousinstitutional and industrial waste, construction debris, and other non - hazardous/ non toxic solid waste. "               
               
(d) WET or BIODEGRADABLE GARBAGE or WASTE  shall refer to post- consumer materilas which would undergo decomposition and/ or can be transformed into some other forms of raw materials of beneficial use, such as soil fertilizers.

(e) DRY or NON - BIODEGRADABLE GARBAGE or WASTE shall refer to post - consumers materials which could be transformed into new products or to another usable materila, or precessed and use as raw material in the manufacture of a recycled products."               
               
SECTION 3.    Each household, institutional, or commercial garbage or waste shall be put in separate receptacles or containers properly marked. i,e., one for the wet or biodegradable and one for the dry
or non - biodegradable, secure and protected from insects and pets, and placed in the customary or usual place where garbage collectors from the Waste Management shall collect them.           
               
SECTION 4.   The Waste Management office is hereby tasked to preapre and promulgate the necessary rules and egulations for the effective implementation of this ordinace.               
               
SECTION 5.    Penalty Clause. Any houseold, business or commercial establisment, institution and industrial and manufacturing plant that will be found or apprehealed not to be complying with this Ordinace shall be penalizd with the fine of  TWO HOUSAND (2,000.00) PESOS   and non- collection of their garbage or waste until such time that the fine is paid."               
               
SECTION 6.   Separability Clause. If this ordinance or any provision of this ordinance shall be declared unconstitutional or invalid, other part or provision hereof which are not affected thereby shall continue
to be in full force and effect. "               
               
SECTION 7.     Repealing Clause. All local ordinance, executive orders and administrative regulations or part of parts thereof, which are inconsistent with any of the provision of this Ordinance are hereby repealed or modified accordingly. "               
               
                           
"SECTION 8.    Effectivity Clause. This ordinance shall take effect after its publication once in a newspaper of general circulation in the locaity and posting for three (3) consecutive weeks in conspicuous places of the Mamburao Municipal Hall. This ordinance shall also be forwarded to the Sangguniang Panlalawigan for its  appropriate action.                               
               
ENACTED AND  APPROVED THIS ON NOVEMBER 23, 2009 AT THE SANGGUNIANG BAYAN SESSION HALL UPON MOTION OF HON. EDUARDO S. MANEJA, JR. CHAIRMAN, COMMITTEE ON FINANCE AND APPROPRIATION DULY SECONDED BY ALL THE MEMBERS PRESENT.
