  MUNICIPAL ORDINANCE NO. 01-96

  AN ORDINANCE FOR THE IMPOSITION OF BUSINESS
TAXES ON BANKS AND OTHER FINANCIAL INSTI-
TUTION AS AUTHORIZED UNDER SECTION 143(f)  OF
THE NEW LOCAL GOVERNMENT CODE 1991.
   
     
     
     
                     
     BE IT ORDAINED by the Sangguniang Bayan of Mamburao Province of
Occidental Mindoro that :
                     
     Section 1)   Title - This Ordinance shall be known as Imposition
of Business Taxes on Banks and Financial Institution of Authorized
under Section 143 (f) of the New Local Covernment Code of 1991.
                     
     Section 2) Scope - This shall govern the collection of bsiness
taxes on banks and financial institutuions within the municipality of
Mamburao.
                     
     Section 3) Imposition of Business Taxes - Thesre shall be a
business tax collected from the bank and other financial institution at
a rate not exceeding fifty percent (50%) of one (1) percent (%) on the
gross receipts of the preceeding calendar year derived from interest,
commisions and discounts from leading activities, income from financial
leasing, devidents, rentals on property and profit from exchange or sale
of  property and insurance premium.
                     
     Section 4) Collection of Business Taxes - The collection of
business taxes shall be the responsibility of the Municipal Treasurer
iof his deputy and shall not be assigned to any other person.
                     
     Section 5) Penal Provision - Any bank or Financial institution
and/or its duly authorized personnel who violate any provision  of this
ordinance shall upon conviction be punished be a ifne Two Thousand
Five Hundred Pesos (2500.00) and/or Six Months Imprisonment upon the
discretion of the court.
     Section 6) Repaeling Clause - All ordinances, rules and
regulations or parts thereof in conflict with or inconsistent
with any provision of this ordinance are hereby repealed or mo
dofied accordingly.
                     
     Section 7) Effectivity - This ordinance shall take effect
upon its approval
                     
     ENACTED AND APPROVED by the member of the Sangguniang Bayan
this 13th day of November, 1995.
