"THIS ORDINANCE REQUIRING OPRETIONS OF FOOD OUTLET, STORES AND OTHER
BUSINESS ESTABLISHMENTS ENGAGED IN FOOD MANUFACTURING/PROCESSORS IN THE
MUNICIPALITY  OF MEMBURAO, OCCIDENTAL ,MINDORO TO IMPLEMENT R.A. 8172,
ENNTITLED "" AN ACT PROMOTING SALT IODIZATION NATIONWIDE AND FOR RELATED
PURPOSE"" OTHERWISE KNOWN AS THE ASIN LAW.

BE IT ORDAINED BY THE SANGUNIANG OF MAMBURAO, OCCIDENTAL MINDORO, in
its session assembled that:
 
           SECTION 1. TITLE  - This ordinance shalol be known as "" An ordinance promoting salt iodization in
the Mamburao, Occidental Mindoro"".

            SECTION 2. DECLARATION OF POLICY - It is a declared policy of local government unit to
promote the health of the people, to maintain an effective food regulatory system, and to provide the entire
population especially women and chiodren with children with proper nutrition. For this purpose, this local unit shall promote
the nutritional fortification of food to combat micronutrient malnutrition as a priority health program.

            SECTION 3. PURPOSES.      The purpose of this ordinance are:

            (a)  to contribute to the elimination of nutrient malnutrition  particularly  iodine  deficiency
disorders, through the cost effective preventive measure of salt iodization;

            (b)  require all producers manufacturers of food-grade salt   to iodized  the salt   that they  produce
manufacture, import, trade or distribute;

           (c)  require the health officers and nutritionist- dietitians, or in thier absence through thier sanitary
inspectors and barangay health workers, to check and monitor the quality of food-grade salt being sold in thier
market in order to ascertain that such salt in properly iodized;"                                                                                           
                                                   
"           (d) provide mechnism and incentives for the local salt industry in the production, marketing, and
distribution of iodized salt;

          (e) ensure the sustainability of the  salt iodization program.

          SECTION 4. DEFITION OF  TERMS       - For   purpose of this ordinance, the following terms and
phrase shall mean:

          (a) MICRONUTRIENT MALNUTRITION - a disorder resulting from deficiences vitamin A,
ions, iodine and other micronutrients which the body needs in minute quantities everyday.

          (b) IODINE DEFICIENCY DISORDERS -  a broad spectrum of deficiences resulting from
lack of iodine in the diet which leads to the reduction of intellectual and physical capacity affecting everyone
who is iodine deficient and may manifest as goiter, mental retardation, physiacal and mental defects.

           (c) FOOD FORTIFICATION - the additio of nutrients  to process foods at levels above the
natural state.

            (d) SALT IODIZATION - the addition of iodine to saltintended for human or animal consumtion in
accordance with specifications as to form, fortification, method, manner and consumption as may be prescribed
by the BFAD.

            (e) FOOD - GRADE SALT - salt for human and animal consumption as distinguish from industrial
salt.

            (f) REGULATORY REQUIREMENTS - the provisions of all applicable laws, regualtions, executive
orders and other enactments related to food quality and for safety, priority, nutritional composition, and other
aspect of food regulation or control.

            (g) INDUSTRIAL SALT - salt used in the treatment, processing, and/or manufacture of non - food
commercial products.

             (h) MANUFACTURER - one who produces, imports, trades in or distributes salts.

             (i) SUBSISTENCE PRODUCER/MANUFACTURER - one who produces  trades in or distributes
salt exceeding two(2) metrics tonss of slat per year.

             (j) SMALL PRODUCER/MANUFACTURER - one who produces, trades in or distributes salt
ranging from more than two hundred tons to three hundred metric tons (300) per year.


             (k) MEDIUM PRODUCER/MANUFACTURER - one who produces, imports, tradess in, or
distributes salt raging from more than three hundred metric tons(300) to two thousand metric tons (2,000) per
year.

               (l) LARGE PRODUCER/MANUFACTURER - one who produces, imports, trades in, or distributes
salt exceeding two thousand metric tons (2,000) per year.

               (m) FOOD OUTLETS -  includes restaurants, eateries, stores and the like.

               (n) BFAD - Bareau of Food and Drug.

               (o) FOOD ESTABLISHMENTS - refers to cafeterias, restaurant, refreshment houses, carinderias,
catering firms and other similar establishments serving food to costumers.

               (p) IODIZED SALT - these refers to the salt fortified with the iodine as defined under the ""Asin Law"",
otherwise known as R.A. No. 8172.

               (q) CUSTOMERS - refers to person or persons entering a food establishment and buying food for
consumption.

               SECTION 5. COVERAGE - The following establishments are covered by this ordinance:

              (a) All covered agencies and institutions. "                                       

             (b) Entire salt industry including salt producers, manufacturers, trades and distributors,
 
             (c) All food establishment and related business such as restaurants, canteens, carenderias, f ds stands,
                  refrshments parlors/snacks, nights clubs, bars, bakeries, bottling, groceries, sari-ari stores and
                  market vendors to sell and use iodized salt or make available to costumers only iodized salt in thier
establishments.

                  SECTION 6. REGULATORY PROVISION
                 (a) All operatos of food outlets, stores, food processors and manufacturers and other business
establishments in the Municipality of Mamburao, Occidental Mindoro shall pay an annual certification fee of 
P10.00 at the Office of the Municipal Treasurer.

                  SECTION 7. ADMINISTRATIVE PROVISIONS

                  (a) all food outlets, restaurants and stores in this municipality are hereby required to make available to
costumers only iodized salt in thier stablishment. Likewisa, all food manufacturers/processors using food-
grade salt are also required to use iodized in thr processing of thier products provided that the use of
iodized salt shall not prejudice the quality and safety of thier products.     

                  (b) The benefts of the use of iodized salt shall be adequately dissemated and promoted through organized, systematic and effective information campaign which shall involve major sectors of the community to be spearheaded by the Municipal Rural Health Office.

                   (c) This local government unit, through its health officers and nutritionist, dietitians, ori thier absence ,
the sanitary inspectors shall check and monitor the quality of food- grade salt being sold or served in such
establishments.

                   (d) Salt producers/manufacturers shall register with BFAD, which sghall maintaian an upbdated registry of
salt producers/manufactureres and shall monitor compliance with the salt iodization program.

                  SECTION 8. PENAL PROVISION - Any person who violates Section 7 of this Ordinances shall be
penalized as follows:

                  a) First Offense - Reprimand from the Municipal Health Officer
                  b) Second Offense - the offender shall , conviction by the Court, pay a fine of not less than Five
Hundred Pesos (500.00)
                  c) Third Offense - The offender shall, upon conviction by the Court, pay a fine of not less than one
                      thousand pesos (1000.00) but not more than two thjousand fove hundred pesos (P2,500.00) or an
                     imprisonment of thirty days(30) or both such fine and imprisonment at the discretion of the court.
                     The subject established sahll also be closed.

                     SECTION 9. REPEALING CLAUSE - All ordinances, rules and regualtions or any part of hereof
which are in conflict with or contrary to the provisions of this ordinance are hereby repealed, amended or
modified accordingly.

                   SECTION 10. EFFECTIVITY CLAUSE - This ordinance shall take effect immediately upon its
approval and review of the Sangguniang Panlalawiagan.

                  Enacted this 10th day of January 2005 at Mamburao, Occidental Mindoro.
