| RESOLUTION ENACTING --AN ORDINANCE |
| RESCLASSIFYING PORTION OF 181, 693 SQUARE METERS |
| OR APPROXIMATELY FOUR (4) HECTARES OF |
| AGRICULTURAL LAND OWNED BY MR. EMMANUEL T. |
| ABELEDA SR. WITH TITLE NO. T-14061 UNDER TAX |
| DACLARATION NO. 01-003-0349- A SITUATED AT BARANGAY |
| TANGKALAN, MAMBURAO, OCCIDENTAL MINDORO TO |
| RESIDENTIAL AREA. " |
| |
| Whereas, Section 20 of the Local Government Code of 1991 provides |
| that a city or municipality may, through an ordinance passed by the |
| Sanggunian after conducting public hearing for the purpose, authorize |
| the reclassification of agricultural lands and provide for the manner of |
| their utilization or disposition. |
| |
| Whereas,reclassification of agricultural lands may be authorize when |
| rthe lands ceases to be economically feasible and sound for agricultural |
| purposes as determined by the Department of Agriculture or where the |
| land shall have substantially greater economic value for residential, |
| commercial, or industrial purpose, as determined by the Sanggunian |
| concerned; |
| |
| Whereas, such reclassification shakll be limited to the following |
| percentage of the total agricultural land area at the time of the passage |
| of the ordinance; |
| |
| a) fifteen percent(15%) for highly urbanized and independent |
| component cities; |
| b) ten percent (10%) for component cities and first to third |
| class municipalities. |
| c) Five percent (5%) for fourth to six class municipalities; |
| |
| Whereas, forwarded before this august. Body is the request of Mr. |
| Emmanuel T. Abelede Sr. for the conversation of agricultural land to |
| residential of approximately 4 hectares of the total area of 181,639 |
| squaremeters located at Barangay Tangkalan, Mamburao, Occidental |
| Mindoro with Title No. 14061 under Tax Declaration No. 01-003-0349- |
| A which was previously clkassified as an agricultural land last june 23, 2003. |

| Whereas, a certification issued by the Department of Agriculture, |
| Mamburao revealed that portion of this area was previously utilized by |
| China- Geo Engineering (Philippines) Corporation for their operation in |
| connection with the project " Mindoro West Caost Road Improvement |
| Project", |
| |
| Whereas, stockpiles of sand and gravels aggrevates were stored in the |
| area and upon ocular inspection the area ceases to be feasible and sound |
| for agricultural purposes. |

| Whereas, certification from the Municipal Planning and Development |
| Coordinators was also issued to attest that approximately four (4) hectares |
| of the 181,639 square meters owned by Mr. Emmanuel . Abeleda, Sr. |
| was formerly utilized a satellite office, motor pool and stockpile of |
| aggravates during the construction of the project " Mindoro West Caost |
| Raod Improvememt Project" |

| NOW THEREFORE, on mass motion duly seconded by the same, this |
| Sangguniang Bayan of Mamburao, Occidental Mindoro hereby enacts; |

| I - Title - This ordinance shall be known as " An ordinance |
| reclassifying portion of 181,639 square meters or approximately four |
| (4) hectares of agricultural land owned by Mr. Emmanuel T. Abeleda |
| Sr. with Title No. t-14061 under tax declaration No. 01-003-0349-A |
| situated at Barangay Tangkalan, Mamburao, Occidental Mindoro to |
| residential area," |
| |
| II - Coverage - This ordinance will cover approximately four (4) |
| hectares of agricultural land owned by Mr. Emmanuel T. Abeleda Sr. |
| situated at Barangay Tangkalan, Mamburao, Occidental Mindoro. |
| |
|
| III - Justificatios/ Limitations - a) This area (4 hectares) ceases to be |
|
| economically feasible and sound for agricultural purpose when it was |
|
| utilized by China-Geo Engineering (Philippines ) Corporation as their |
|
| satellite office, motor pool and stockpile of sand and gravel aggravates. |
|
| |
|
| b) This four (4) hectares is way below the ten 10% limitation of th |
|
| total agricultural land of this municipality that can be reclassified into |
|
| residential area. |
|
| |
|
| |

| |
|
| c) Once reclassified a low cost housing project will be undertaken |
|
| by the owner/ developer in coordination with the National Housing |
|
| Authority. |
|
| |
|
| IV - Effectivity - this ordinance shall take effect upon its approval and |
|
| upon review of the Sangguniang Panlalawigan. |
|
| |
|
| Enacted this 30th day of october 2007 at Mamburao, Occidental |
|
|
| Mindoro. |
