    MUNICIPAL ORDINANCE NO. 01
Series 1998
     
                     
  AN ORDINANCE INTITUTUING A GARBAGE  DISPOSAL AND MANAGEMENT
SYSTEM AND PROVIDING THR FEES AND PENALTIES FOR VIOLATION THEREOF.
                     
       Be it ordained by the Sangguniang Bayan of Mamburao, Occidental Mindoro in session
assembled, that:
                     
       Section 1.      THE TITLE ORDINANCE 
                     
       This ordinance shall be known as the " Ordinance Instituting A Garbage Disposal and
Management System and Providing the Fees and Penalties for Violation Thereof".
                     
       Section 2. SCOPE OF ORDINANCE 
                     
       There is hereby a fixed monthly garbage collection fee for all residential buildings and
commercial estagblishments in area covered by the garbage collection system under the
following schedules:
                     
a.    Single detach dwelling unit with a fllor area of:
        1.  100 square meters or more
        2.   Less than 100 square meters
b.    Multiple dwelling/partment style ect.
c.   Commercial Establishments

                 Such as groceries, sari-sari store, drugstore, banks, gasoline stations,
dealers of motor vehicles, spare parts, rice and other grain dealers, public
hospitals, restaurants, tailoring shops, dress shops, beauty parlors, nights clubs,
bars, hotels, and travelers inn, ice plants, boarding houses, dormitories,
barbershops, funeral parlors, cockpit, billiard and pool theaters. photo sjops,
motor repair shops, warehouse, operators  of cargo  or delivery  vehicles,
rpinting shops and all other establishments not specially provided for in any
of the above classification:
                       
                     
  1         square meters or less - 5.00/mo.      
  2.        26-100 square mmeters  - 10.00/mon.      
  3.        51-100 square meter - 15.00/mo.      
  4.        More than 100 sq. menters
           but les than 200sq. Mweters
- 20.00/mo.      
  5.        More than 200 sq. meters
           but less than 500 sq. meters
- 25.00/mo      
  6.        More than 200 sq. meters
           but less than 500 sq. meters 
- 50.00/mo.      
  7.        More then 1,000 sq. meters - 100.00/mo      
                     
      Section 3.    COVERAGE      
                     
       All government and commercial establishments including non-profit organization
are required to pay the corresponding fees provded for in this ordiance.
                     
      Section 4.        Where there are two or more kind of business conductedin the
same address by the same owner/operator, he shall pay the fees of the business with the
highest rate plus twenty percentum (2%) of the rate herein prescribed for the other
business/es.  
                     
      Section 5.        In all collection fees coming from all residential buildings and
commercial stablishments located in their respective barangay, the barangay council shall
be given a share of Ten percent (10%) in all collections made thereon and ten percent
(10%) to Brgy. Fatima as host of dumping site area.
                     
      Section 6.       The Municipal Mayor is hereby authorized to promulgate rules and
regulations for the effective collection collection of garbage fees herein imposed taking into
consideration the collection effeceincy and public convenience. Provide that the
Municipal Mayor may authorized a Ten percent (10%) discount for any taxpayer that pays
the entire amount of the fees for the whole years, and five percent (5%) discount if the
payout is made on a semi - annual basis.
                     
      Section 7.        All payments of the prescribed fees shall be paid directly to the
Municipal Treasurer of ant duly designated/authorized representative on or before the
fifth day of avery month. The Municipal Treasusrer is also tasked to deposit all collection
fees relative thereto and will serve as general fund.
                     
      Section 8.        The office of the Municipal Assessor is empower to determine
the actual area of all residential buioldings, business and commercial establishments
                     
      Section 9.        Failure to pay the garbage collection fee on time as herein
provided shall subject the owner to surcharge of two percnet(2%) for every month or a
fraction thereof. There shall be maximum time to pay the monthly fees of three(3)
months subject to the penal provisions found out section 17 of this ordinance.
                     
      Section 10.      Mayor's Permit shall not be issued or received unless the garbage
collection fee herein prescr5ibed paid in full and up- to- date.
                     
      Section 11.      It shall be unlawful to throw garbage and other waste materials
into the canals and all existing bodies of water and other and other places not designated for the
purpose.
                     
      Section 12.      Residential houses in the poblacion, which are situated in areas not
reactable by garbage truck, by the reason of road conditions or narrowness of pathways or
"iskinitas", should dump their garbage in an area to be designated by the Barangay
council of the locality in which the condition or situated occurs.     
                     
      Section 13.      Owners/occupants building commercial and business
establishments, government building and offices, civic, office and their  sector and all
market vendors and required to use plastics bags, Such bags shall be properly sealed or tied to
prevent scattering of their contents. These plastic bags shall be provided by Municipal
Government which will be paid by the barangay upon receipt of the said bags. These will be
distributed to the different barangays who in turn will collect the  corresponding fees thereto.
This will serve as  additional source of revenue.
                     
      Section 14.     All utility vehicles and like are required to put/install trash
can inside their vehicles.
                     
       Section 15.      The Municipal Engineer with prior approval from the Municipal Mayor
shall fix the day and time for the collection of garbage in the different sector of the
municipality. He shall post in conspicious placea "schedule of garbage collection" notices in
the different sectors. The placing of garbage outside the premises other then day and time
scheduled is hereby prohibited. 
                     
      Section 16.      Arresting officers Members of the local PNP, Mayor's Representative,
Barangay Officials and Sanitary Inspectors assigned in the municipality  ar5e hereby aurhorized
to apprehend or arrest persons violating this ordinance.
                     
      Section 17.      PENAL PROVISION - Any person who violates this ordinance shall,
upon conviction, be punished by the fine of Two Hundred Pesos(p200.00) for the first offense,
Three Hundred pesos (P300.00) for the second offense and five Hundred Pesos (P500.00) with
imprisonment of not more than 15 to 30 days for the thrid offense subject to the discretion of
the court.
                     
       Section 18.       Repealing Clause - All orcinance, rules and regulations and parts thereto,
which are in conflict or inconsistent with any provision of this ordinance are hereby repealed
or modified accordingly.
                     
      Section 19.       EFFECTIVITY - This ordinance shall take effect immediately upon
approval and after the required publication in a newspaper of ganeral circulation within the
province.
