MUNICIPAL ORDINANCE NO. 05
"AN ORDINANCE ADOPTING REPUBLIC ACT NO. 9255 ENTITLED ""AN ACT ALLOWING
ILLEGITIMATE CHILDREN TO USE THE SURNAME OF THEIR FATHER AMENDING FOR
THE PURPOSE ARTICLE 176 OF EXECUTIVE ORDER NO. 209, OTHERWISE KNOWN AS THE
""FAMILY CODE OF THE PHILIPPINES.""
SECTION 1. TITLE - This shall be known as "" An ordinance adopting Republic Act No.
9255 entitled an act allowing illegitimate children to use the surname of their father amending for the
purpose Article 176 of Executive Order No. 209, otherwis known as the Family Code of the
Philippines.""
SECTION 2. DECLARATION OF POLICY - The Municipal Government of Mamburao,
Occidental Mindoro recognizes the FIlipino family as the foundation of the nation. Accordingly , it shall
strenghten its solidaryty and actively promote its total development.
SECTION 3. PURPOSE - The purpose of this ordinance is to allow illegitimate children use the
surname of thier father after their filiation has been expressly recognized by the father through the record of
birth appearing in the civil register, or when admission in a public document or private handwritten instrument
is made by the father.
SECTION 4. DEFINITION TERMS AND PHRASES - When used in this ordinance, the following
term and phrases shall mean:
(a) Documentation Fee - an amount which will cover the recording of document
and a subsequent issuance of registrant's copy.
(b) Father - the male parent
(c) - a statutory proceeding to estalished the paternity
of an illigetimate child in order to impose the duly of support.
(d) - begotten and born out of wedlock
(e) - lawful; born in wedlock
(f) - female parent
(g) - a natural right and duly of parents over the person and property
of their unemancipated children, it shall also include the caring
for and rearing them for civic conciousness and effeciency and the
development of their moral, mental and physical character and well-being.
(h) Surname - family name
SECTION 5. ADMINISTRATION PROVISION - For every application filed in the Offive of the
Municipal Civil Registrar the applicant shall pay a documentation fee P500.00 at the Office of the
Municipal Treasurer. Upon payment of the required fee the Office of the Municipal Civil Registrar shall record
such registrtion in a seperate logbook and subsequently issue the corresponding registrant's copy.
SECTION 6. REPEALING CLAUSE - all local laws, rules nad regulations which are inconsistent
with the provisions of R.A. 9255 are hereby repealed or modified accordingly.
SECTION 7. EFFECTIVITY - This ordinance shall take effect fifteen (15) days after its
publication in a newspaper of local circulation and/or posting in conspicuous places within the jurisdiction of
this municiapality and after the required review by the Sangguniang Panlalawigan. "
